Report on Matters before the Summary Court for contravention of referenced sections of the Cayman Islands Labour Law (2011 Revision)

1. Company: Island Builders Ltd.

Owner/s (or if T/A): DEAN and JENNIFER SCOTT

Charges: 106 charges of Failure to Pay Overtime Pay, contrary to section 25 (1) of the Labour Law (2011 Revision).

UPDATE: The matter was mentioned in Summary Court on June 11, 2014 and matter adjourned to next mention date of March 24, 2015.

2. Company: Front Door Cayman Ltd.

Owner/s (or of T/A): Harmukhdev (Harry) Lalli

Charges: 38 Charges of Failure to pay Overtime Pay contrary to section 25 (1) of the Labour Law (2011 Revision).

UPDATE: The Matter was first mentioned in Summary Court on September 16, 2014 and has been set down for a further mention on October 7, 2014.

3. Company: Sail Inn Restaurant

Owner/s (or if T/A): Mario D. Rankin

Charges: 28 charges of failing to pay Overtime Pay contrary to section 25 (1) of the Labour Law.

UPDATE: On the last appearance September 11, 2014, payments have been made towards outstanding amounts and the case is next set for mention on January 15, 2015.

4. Company: M & R Construction

Owner/s (or if T/A): Michael Witter

Charges: 4 charges of Failing to Comply with an Award of a Labour Tribunal contrary to section 76 of the Labour Law (2011 Revision).

UPDATE: On the last appearance date, the matter was set for mention on October 20, 2014 at which time a date for trial will be set.

5. Company: ARALCO LTD

Owner/s (or if T/A): Winston Salmon

Charges: 1 charge of Failing to Comply with an order of a Labour Tribunal contrary to section 76 of the Labour Law (2011 Revision)

UPDATE: On the last appearance date, the matter was set for mention on September 29, 2014 at which time a trial date will be set.

6. Company: ARCP LTD.

Owner/s (or if T/A): Peter Young, Justin Woods, Samuel Young

Charges: 7 charges of Failing to pay Outstanding Wages contrary to section 30 of the Labour Law (2011 Revision)

Update: All outstanding monies have been paid to employees and the matter is still in the Summary Court awaiting further actions as per the rules of the Court.

7. Company: BLUE EYES GRANITE

Owner/s: (or if T/A): George and Sally Craig

Charges: 5 Charges of Failing to Comply with and order of the Labour Tribunal contrary to section 76 of the Labour Law (2011 Revision)

Update: The matter has been adjourned sine die; however all matters still remain on file.

8. Company: K9 SECURITY SERVICES

Owner/s (or if T/A): Sterling and Penny Rivers

Charges: 45 charges of Failing to pay Overtime Pay contrary to section 25 (1) of the Labour Law (2011 Revision)

Update : All monies owed have been paid and this matter has now been disposed of.
