      Matter adjourned to 27th February 2014 to continue to monitor compliance of payments ordered by the court.

      Matter resolved. Charges withdrawn and dismissed as full Pension payments have been made.

      Employer continues to be compliant with agreed payments against the arrears, as well as maintaining current payments. Prior to these arrears the employer was in good standing.

      Defendant failed to appear- Warrant of Arrest Issued.  No arrest made as yet.

      • Failing to make contributions to a plan for employee. (Sec 4 (3))
      • Failing to pay arrears within time given (Sec 48 (3))
      • Failing to supply Information (Sec 82 (3))

      Matter adjourned to the 24th April 2014 by which time the necessary agreement should have been reached by all parties as to what payments will be made to clear the arrears.

      Matter adjourned to the 6th February 2014. Accused to liaise with his attorney as charge No 1 was withdrawn and he expressed to the Magistrate his intention to plead guilty to the other charge.

      Pleaded guilty on the 6th February 2014, both company and himself however, Mr. Fergusson was absent so the matter was adjourned until the 13th March to be dealt with after submissions by Mr. Fergusson.

      On the 30th October 2013 a cheque was received by the British Caymanian Pension Plan for CI$ 138,861.51 to pay off employee’s pension arrears. Matter now resolved.

      Defendant failed to appear - Warrant of Arrest Issued.

      • 8 counts of failing to supply information (Sec 82 (3))
      • 26 counts of failing to make Contributions (Sec 4 (3))

      Matter adjourned to the 20th February 2014 trial dates vacated. Meeting to be held with all parties and legal, to look at documentation produced and the way forward to resolve.

      Matter adjourned to the 13th February 2014 attorney Mr. Allen addressed the court and said his client had sent the relevant documentation to the Registrar of Companies for the the business to be dissolved. Mr. Ferguson to address.

      Further adjourned to the 19th February when Crown Counsel Mr. Ferguson is present

      • Seventeen counts of failing to contribute to a pension plan. (Sec 4(3))

      Dialogue with the employer to rectify this situation so that efforts to enroll all accounts to be made for funds to be remitted. Matter adjourned until the 27th March 2014.
